This Standard Image License applies to all digital images purchased through 40 Day Living or licensed directly by 40 Day Communications, LLC.

1. What You’re Licensing

When you purchase a digital image from 40 Day Living, you are granted a non-exclusive, non-transferable, worldwide license to use the image under the terms below.

This means you can use the image in personal and commercial projects, but you do not own the copyright. You have permission to use the image, not to resell or claim it as your own.

2. Permitted Uses

You may use purchased images in:

• Commercial design projects (websites, social media, digital ads, business cards, packaging, etc.)
• Editorial content (blog posts, articles, educational content, magazines)
• Printed media (flyers, brochures, product labels, postcards, books)
• Client work (e.g., for graphic designers, consultants, or agencies purchasing on behalf of a client)
• Personal use (home décor, inspiration boards, gifts, digital collages)

This license covers unlimited projects, no expiration, and worldwide use—as long as the use stays within the allowed terms (see below).

3. Prohibited Uses

You may not:

• Resell, redistribute, sublicense, or offer the image as-is or modified in stock libraries, templates, AI datasets, NFTs, or bundles
• Claim the image as your own original work
• Use the image in a logo, trademark, or brand mark without express written permission
• Use the image in any way that is pornographic, defamatory, violent, or unlawful
• Share the image with others (except as part of your own project deliverable)
• Use the image in mass production for resale, such as merchandise or print-on-demand products (e.g., T-shirts, mugs, posters) — unless granted an Extended or Exclusive License (see Section 5)

4. Copyright & Ownership

All images remain the sole property of 40 Day Communications LLC. You are licensing the right to use the image; you are not buying the copyright.

The original photographer, Cheryl Williams, retains all rights, including the right to resell, relicense, or withdraw the image from future sale.

5. Want Exclusive Rights?

If you want to be the only person allowed to use a specific image, you can request an Exclusive License. (Please note: if the image was already purchased, an Exclusive License can NOT be issued.)

To request exclusive use:

1. Visit the Contact Us page on our website.
2. Let us know the image name or preview, and how you plan to use it.
3. A custom agreement and price quote will be provided.

Once an image is sold with exclusive rights:

• It will be removed from sale on the site.
• You’ll receive a certificate of exclusive license and usage terms tailored to your project.

Exclusive licenses start at $150 and vary based on use.

6. Legal Protection & Enforcement

All digital image uses are tracked. Any violation of this agreement—such as resale, redistribution, or copyright infringement—will result in:

• Immediate revocation of your license
• Legal enforcement under the U.S. Copyright Act
• Claims for damages, attorney’s fees, and injunctive relief

40 Day Communications takes copyright enforcement seriously and reserves the right to pursue all available remedies in court.

8. Attribution (Optional but Encouraged)
